Access Terms for Product Information and Consumer Medicine Information Documents ("Licence")

Parties

You or Your means any legal person or entity who accesses or downloads a PI Document or CMI Document from Our website

and

Us, We or Our means the Commonwealth of Australia as represented by the Therapeutic Goods Administration ABN 40 939 406 804 of 136 Narrabundah Lane, Symonston ACT 2609, Australia.

Operative Provisions

  1. Nature of agreement
    • 1.1  This Licence specifies the terms and conditions of Your access and use of PI Documents and CMI Documents made available to the general public by Us via Our website.
    • 1.2  You acknowledge and agree that accessing PI Documents or CMI Documents in accordance with this Licence is beneficial to You because it provides You with product information about therapeutic goods and is beneficial to Us because it assists Us in our portfolio responsibilities.
  2. Terms of access
    • 2.1  We grant to You a perpetual, non-exclusive, royalty-free, world-wide, irrevocable and non-transferable licence to download, store in cache, display, print and copy a single copy or part of a single copy of a PI Document or CMI Document made available via Our website.
    • 2.2  If You wish to use any PI Document or CMI Document for purposes other than those specified in clause 2.1 of this Licence, You must seek the permission of the Sponsor.
    • 2.3  We may remove a PI Document or CMI Document from Our website at any time in Our sole discretion.
  3. Exclusion of liability
    • 3.1  You acknowledge and agree that You are responsible for making Your own enquiries to determine whether any PI Document or CMI Document is accurate, up to date and fit for Your purposes.
    • 3.2  The PI Document or CMI Document is provided to You for the purpose of disseminating health information free of charge for the benefit of the public.  This Licence and any PI Document or CMI Document made available to You via Our website is not a substitute for independent professional advice.  Nothing contained in this Licence or any PI Document or CMI Document made available to You via Our website is intended to be used as medical or other advice and it is not intended to be used to diagnose, treat, cure or prevent any disease, nor should it be used for therapeutic purposes or as a substitute for Your own health professional's advice.
    • 3.3  You acknowledge and agree that We do not accept any legal liability or responsibility (including for negligence) for any injury, loss or damage incurred by Your use of, disclosure of, or reliance on, the information contained in any PI Document or CMI Document made available to You via Our website (including for any inaccuracy in, or reliance on, the information in a PI Document or CMI Document or use of a PI Document or CMI Document to achieve a medical outcome or therapeutic good supply arrangement) regardless of any involvement by Us including in the creation or approval of any PI Document or CMI Document.
  4. General Provisions
    • 4.1  This Licence is governed by, and is to be construed in accordance with, the law of the Australian Capital Territory.
  5. Agreement
    • 5.1  By clicking, "I accept" You agree to the terms and conditions of this Licence and that You have authority to accept the terms and conditions of this Licence.  You agree that any PI Document and CMI Document made available to You via Our website is provided on the terms and conditions of this Licence only.  If You do not agree to the terms and conditions of this Licence, click "I do not accept".
  6. Definitions
    CMI Document
    means a consumer medicine information document provided to Us by the Sponsor of the therapeutic good to which the document relates and made available to You via Our website.
    Commencement Date
    means the date You accept the terms and conditions of this Licence by clicking "I Accept".
    PI Document
    means a product information document provided to Us by the Sponsor of the therapeutic good to which the document relates and made available to You via Our website.
    Sponsor
    has the meaning given to that term in the Therapeutic Goods Act 1989.
Background
  1. We require Sponsors of some therapeutic goods to provide Us with current product information and consumer medicine information documents. This includes all prescription medicines, as well as some registered non-prescription medicines and some biologicals.
  2. The PI Documents and CMI Documents made available via Our website have been developed by the Sponsor of the relevant therapeutic good and provided to Us for publication on Our website.
  3. The Sponsor has given Us a licence to allow You to access their PI Documents and CMI Documents on the terms and conditions of this Licence.
  4. The terms and conditions of this Licence are in addition to any copyright, security, disclaimer or privacy statements on Our website.
